Lawsuit: Police Sic Dog On Man, Hogtie Him Face Down Until He Died

According to the lawsuit, Goode’s treatment by police was nothing short of torture. In regards to the police and their use of the K-9, the lawsuit exposes downright sadistic and inhumane behavior by the officers.

    Troy Goode had taken LSD at a concert he and his wife attended in Southaven, Mississippi, but must have been having a bad trip and began acting erratically, running around the parking lot. Though the Memphis, Tennessee, man’s behavior wasn’t violent or threatening to anyone, someone felt it necessary — likely out of misguided concern — to summon the police. That fateful decision by a stranger cost Goode his life.

    Inept police arrived on scene and, as bystander video footage revealed, forcefully hogtied Goode, placing him face-down — a position known to be potentially deadly — and loaded him onto a stretcher and into a waiting ambulance.

    “They hogtied him. That’s such a bad idea,” one witness can be overheard saying in that footage. “He’s currently face-down, on the stretcher,” says another. Shortly after that, a third bystander — who could not have imagined how truly portentous her statement would be — advised her companion, “Video it, just in case he dies.”



    Tragically, an hour after arriving at the hospital, that’s exactly what happened.

    Southaven Police maintain the absurd and unscientific claim Goode’s death was caused by his consumption of LSD. A Mississippi medical examiner’s report lists “complications of LSD toxicity” as the cause of death and “accidental” as the manner, according to MS News Now.

    Police have also claimed Goode was combative, threatening officers and resisting arrest, and his violent behavior continued inside the ambulance. Southaven Mayor Darren Musselwhite even issued a statement in support of this claim, going as far as saying Goode never said he couldn’t breathe — despite the bêtise of such a claim. Goode’s physical and mental distress was clearly evidenced in the video and backed up by audio of bystanders’ narration of the incident.

    As the Free Thought Project previously reported, his friends, family, and an independent autopsy tell a different story, saying Goode — who suffered from asthma — was denied his inhaler, and it was police’ excessive force and use of a dangerous restraint that killed him.

    “He was suffocating. His heart[rate] increased into what is called tachycardia. There is no scientific basis to attribute his death to LSD,” said attorney Tim Edwards in November. “This was lethal force, putting someone in a prolonged hogtied position … The toxicology report … rules out any drug-related causes. That takes that off the table. LSD does not cause heart failure.”

    On Wednesday, as they promised in November, Goode’s family filed a federal lawsuit against Southaven Police, the City of Southaven, several individual police officers and medical workers, the hospital where he was treated, and others — citing the violation of his civil rights.

    According to the lawsuit, Goode’s treatment by police was nothing short of torture. In regards to the police and their use of the K-9, the lawsuit exposes downright sadistic and inhumane behavior by the officers:

    • Troy approached the K-9 unit patrol car and opened the door in an attempt to voluntarily submit to police authority and enter the patrol car to be taken into custody.
    • When Troy opened the door to the patrol car the police dog, a Belgian Malinois named “Weasel”, got out of the vehicle but was not aggressive.
    • Defendant Scallorn grabbed the police dog by the collar, restraining it and preventing it from attacking Troy.
    • Troy, who was an animal lover, began to talk in friendly terms to the dog.
    • At that point and time, one or more of the Defendants willfully, intentionally, wantonly, and with reckless disregard for Decedent’s well-being commanded the police dog to attack Troy.
    • Defendant Scallorn intentionally released the police dog to allow it to attack Troy.

    Southaven Police Chief Tom Long recently announced his retirement as of January 22nd, after 26 years in that post and 38 years in law enforcement. Long, 61, “is leaving a department where he started as the first officer hired by the city,” reported the Associated Press. Of course, the timing is purely coincidental.

    Though the family of Troy Goode is seeking a nominal $150,000 in damages, the true motivations for the lawsuit appear more altruistic. They have requested class-action status for the claim — an apparent effort to ensure no other family has to face such a tragedy from needless use of force by police.

      • I guess you need to take lessons on humanity, if you ever got into situation where police mistook you for being intoxicated (after head injury, seizure, heat stroke), maybe you’d regret saying it. Regardless the punishment for taking drugs is not capital. It just shows you how cruel or insensitive our police is. I’m a physician and I’ve lot of sympathy for mankind. Please be kind.

      Don’t even have to see the video to know the cops are lying. As usual. So they started grabbing a guy, who didn’t need to be grabbed, and had a right to not be grabbed by vicious strangers, then pummeled him for ‘resisting’ when he wasn’t resisting an arrest (for what crime anyway) but simply resisting being assaulted by licensed goons. And killed him. That’s what cops do. Everywhere in the nation, that’s what cops do.

        983 people were killed by police in 2015, according to the Washington post (out of over 318 million people in America). 491 were white. 256 were black. 167 were hispanic. 782 had a deadly weapon in their possession. Only 93 out of the 983 were unarmed.

          OK, so you are a police apologist and find it perfectly acceptable that police kill people, armed or not. Let remember the rest of the facts. First, there is no national database that law enforcement agencies must report to so the Washington post at best is counting only those cases that were in the national news media. Second, being in possession of a deadly weapon is in many to most circumstances not a crime, and the data does not show how many were in possession versus how many actually brandished a deadly weapon or showed any immediate attempt to use the weapon against police, or that were not in a situation (such as police home invasions) where it was perfectly reasonable for them to use a weapon to protect themselves. And third, it doesn’t matter if the number of unarmed people killed by police is 9830, 983, 93 or 9 . . . it is TOO MANY for us in a nation conceived in liberty to accept from those who are supposed to protect and defend us. Finally, fourth, your numbers don’t show the massively high number of incidents of morbidity related to unnecessary police-instigated violence that did not result in mortality. With the mentality of our police, every single police-civilian encounter is a potential for morbidity or mortality.

      We have all heard the “but he wasn’t doing anything” too many times. If he wasn’t doing anything the police wouldn’t have been summoned in the first place. In the video he is being hog-tied by 6-7 officers. This doesn’t happen unless it needs to happen and they never just randomly hog tie people. He was obviously violent and out of control to end up like that whether it was because of the LSD or not it was still his fault so they need to quit crying about what happened.

Have 2 friends that work as law enforcement, one local the other federal. Sure there are some bad cops out there but the majority of them are simply doing a hard job as best they can. What they don’t do is just randomly pick out a person and decide to beat on them. They definitely aren’t going to do this when they are under a microscope with the rest of the world watching just waiting for them to screw up.

          Have you ever tried to get the upper hand on someone who’s on LSD? Good luck unless you have 5 or 6 cops with you, on your side. Any less than that would not be able to take such a person down due to the strength they gain and the absence of pain. I’d like to see what you would look like it they put you in a room together with a drug addled person and tell him to subdue the guy and get cuffs on him.

We Blacks have been experiencing this for decades and now whites are beginning to get the same treatment. The complication here was caused by police who didn’t have any concern for the wellbeing of this person. It’s all on them because they are legally responsible for the safety of someone they arrest.

        If this guy were black, more than likely he would have been SHOT. This guy died from a drug overdose. He was resisting arrest, fighting cops, etc…He wasn’t beaten, and you don’t die from being hogtied/restrained for a few minutes….LOL at “trying to talk friendly to the dog because he’s an animal lover.” He got to the hospital and they tried to treat him. I feel for the guy, but case closed….his family will get some kind of settlement anyway.

          You can’t die from LSD, so that means this guy died from health complications caused by the police. When police arrest someone, they become wholly responsible for that person’s wellbeing under the law. That means, if that person dies, it’s on the police.

        Poor white Tennesseans have seen just as much abuse from Tennessee police as AA my friend ,make no mistake about it they have killed twice as many poor whites than AA in the last ten years.         In most places it seems like the less money you APPEAR to have, the worse you’re treated by the police. Caucasians have been getting kicked out of the middle class (along with everyone else) for about 50 years now, and I think that’s why more and more white people have been experiencing police brutality. Of course minorities have always known about police brutality first hand.

        I’m not trying to say race isn’t a factor, but this has always been a very classist country. Maybe more now than ever.

        PS: when i say ‘the police’ I don’t mean every single cop. there are good cops, but they need to stand up to this ruthless culture that infects too many police forces.

      LSD does cause tachycardia. If he had prior respiratory issue, the excessive stress on the heart can cause death. Police can not sedate him, they do not carry tranquilizer. EMT must not have arrived yet. And without chemical restraint, the physical restraint is necessary.

        LSD didn’t kill this man. If LSD and respiratory issues were linked, thousands would have been dead over the years from it’s use because tons of people have respiratory issues. EMT must have been there since they put him on a stretcher into an ambulance, but left him hogtied on his chest. And there was not a need to leave him on his chest, they just weren’t thinking about any complications, but that doesn’t absolve them as they are responsible for the physical wellbeing of anyone they arrest under the law.

      They went on to say that he was hogtied, his back was bowed, and his head was strapped down, pulling him in the opposite direction.

      Goode, they said, was hogtied while being transported, which is not allowed, and was not released from his restraints until he stopped breathing.

      “They could have sedated this allegedly dangerous 6’1, 150-pound science nerd,” Edwards said, explaining that there were other alternatives to keeping Goode hogtied.

      Their forensic pathologist found Goode had a heart problem due to the prolonged amount of time he was hogtied.

          No, it’s legally a factual statement. Under the law, when a person submits to arrest, they are giving up their right to their own safety and wellbeing. Because of this, Supreme Court ruled police are then wholly responsible for their safety and can be liable if they endanger it.

And why should they NOT restaint someone. He was a danger to himself and possibly others. I have worked with drug addicts. Their behavior Do change quite often very quickly, unless you are trained to notice the sign beforehand, then you are in dangerous situation. Police do not access to chemical restaint or training to handle mental patients. Maybe we can create a separate section of police department that handles mentally ill people, but that cost money.       I’m amazed at how many law abiding people there are and how many feel that law enforcements job extends beyond arrest. It seem that many commenters feel that anyone that breaks the law, even for minor infractions, are subject to summary execution. I would ask these people to watch some of the films of German police in the late ’30’s and their actions towards those who’s only crime was being Jewish which was, at that time, illegal. Law enforcements job is to arrest and hold until the court system can mete out justice.

        Adam I was a teenager back in the 60’s and yes people died from LSD. At Woodstock someone was passing out bad acid and people got sick and some died so that statement is just false. So now people don’t want the police armed or to have tasers because both have killed people and now they can’t have dogs either. This is getting so stupid.
